Additional Information about Notary Services in Colorado

Colorado notaries must be commissioned by the Colorado Secretary of State. To become a notary, an applicant must pass a state-approved exam and meet certain requirements, including being at least 18 years old, a resident or qualified to work in Colorado, and able to read and write English.

Colorado requires notaries to verify the identity of signers using a valid, government-issued photo ID, such as a driver’s license or passport. Notaries in Colorado are not permitted to rely solely on personal knowledge to identify a signer; an ID is required in most cases.

Colorado requires notaries to maintain a journal of all notarial acts, which includes details such as the date, type of notarization, and signer’s ID information. The journal may be physical or electronic and serves as a record in case of disputes or legal issues.

While notaries can notarize documents that may later require an apostille, the notary is not responsible for obtaining the apostille itself. Apostilles in Colorado are issued by the Secretary of State for documents intended for use abroad.

Colorado sets a maximum fee of $15 per notarial act, although additional fees may be charged for travel or other expenses, as long as they are disclosed upfront.

Colorado allows remote online notarization (RON), enabling notaries to perform notarizations remotely using secure, approved online platforms. Notaries must register separately with the Secretary of State for this service and follow strict identity verification and record-keeping protocols.

Notarizing for Close Family Members: Colorado law prohibits notaries from notarizing documents for immediate family members, such as spouses, parents, children, or siblings, to avoid conflicts of interest.

Unauthorized Practice of Law: Colorado notaries are not allowed to provide legal advice or draft legal documents unless they are also licensed attorneys. This includes advising signers on document content or implications.
